1. Introduction

This Acceptable Use Policy ("AUP") governs the use of all services, systems, and infrastructure provided by Estalytics Ltd (trading as Stalytics), ("Stalytics", "we", "us"), including, but not limited to, website hosting, development environments, and any associated network resources (collectively, the "Services").

This AUP is incorporated by reference into our Master Terms & Conditions. A violation of this AUP constitutes a breach of the Master Terms & Conditions. By using our Services, you agree to abide by this policy.

2. Prohibited Activities

You may not use our Services to engage in, promote, or facilitate any of the following activities.

2.1. Illegal and Harmful Content

  • Transmitting, storing, or distributing any content or material that violates any applicable law or regulation in the United Kingdom or your jurisdiction. This includes, but is not limited to, material that is defamatory, fraudulent, or obscene.
  • Hosting, distributing, or linking to any material that exploits children or depicts child abuse. We have a zero-tolerance policy for such content and will report it to law enforcement authorities immediately.
  • Creating or transmitting content that harasses, threatens, or encourages bodily harm or destruction of property.

2.2. Security and Network Abuse

  • Distributing or executing malicious software, including, but not limited to, viruses, malware, worms, trojans, or any other software intended to damage or disrupt a computer, network, or system.
  • Attempting to gain unauthorised access to, or interfere with, any computer system, network, account, or data belonging to Stalytics, its clients, or other third parties. This includes, but is not limited to, any form of hacking, port scanning, or vulnerability scanning.
  • Initiating or participating in any attack that interferes with another user's or network's ability to access services, including, but not limited to, Denial of Service (DoS) and Distributed Denial of Service (DDoS) attacks.
  • Any activity that disrupts the stability, security, or performance of Stalytics' systems, networks, or those of third parties, such as consuming excessive network resources.

Stalytics reserves the right to monitor its network and systems, including data traffic, to ensure compliance with this AUP and to maintain the security and integrity of the Services.

2.3. Email and Communication Abuse

  • Sending, or assisting in the sending of, unsolicited bulk email (spam). This includes, but is not limited to, hosting websites or services that are advertised via spam.
  • Forging or misrepresenting email headers or other identifying information.
  • Creating or hosting websites or sending emails designed to deceive users into disclosing personal or financial information (phishing).

2.4. Intellectual Property Infringement

  • Using the Services to infringe upon the patent, copyright, trademark, trade secret, or other intellectual property rights of any third party. This includes hosting or distributing unlicensed software, music, videos, or other copyrighted materials. If you believe your intellectual property rights are being infringed by one of our clients, please refer to our Copyright Policy for reporting instructions.

3. Enforcement and Violations

Stalytics reserves the right to investigate any suspected violation of this AUP. If we determine that a violation has occurred, we may take action, with or without prior notice. Any action taken will be proportionate to the severity of the violation and may include one or more of the following:

  • Issuing a formal warning.
  • Suspending or temporarily disabling access to the Services.
  • Removing the offending content.
  • Terminating the Services and the Principal Agreement.
  • Reporting the activity to law enforcement authorities. Stalytics may also, at its discretion, escalate severe violations to relevant regulators or seek remedies through the courts.

4. Reporting Violations

To report a suspected violation of this AUP, please contact us immediately at security@stalytics.com, providing as much detail as possible to assist our investigation.

5. Policy Updates

Stalytics may update this AUP from time to time. This page will always host the latest version. Continued use of the Services after a change has been posted constitutes your acceptance of the new AUP.

6. Governing Law

This AUP shall be governed by and construed in accordance with the laws of England and Wales.
